The state board of appraisal is holding a stakeholder meeting on proposed legislation to recoup investigation costs. THE PLACE OF THE MEETING IS CHANGED.

At its October 16th meeting, the Board approved draft language of proposed legislation to recover its investigation and administrative hearing costs. The Board has scheduled a Stakeholders/Rules Committee Meeting to accept comments from stakeholders and the general public regarding proposed
amendments to the Board statutes as follows:
32-3640. Administrative costs
Pursuant to a final order of the board, administrative law judge, or a
consent agreement, when a license or certificate holder has been found to have violated a provision of this chapter or a rule promulgated pursuant to this chapter, the board may assess the license or certificate holder its administrative costs and expenses incurred in conducting the investigation, informal hearing or formal hearing. "Administrative costs and expenses" include but are not limited to monies paid by the board to contract investigators for appraisal investigations, fees paid to certified reporters for appearances or transcripts and expenses incurred with the
Office of Administrative Hearings for conducting formal hearings. The board shall deposit, pursuant to sections 35-146 and 35-147, all monies collected pursuant to this section in the board of appraisal's fund to defray the board's expenses in connection with disciplinary investigations and hearings. Notwithstanding 35-143.01, these monies may be spent on investigations and hearings without legislative appropriation.
In addition, written comment will be accepted at the Board office, 1400 West Washington, Suite 360, Phoenix, Arizona 85007 between the hours of 8:00 a.m. and
5:00 p.m. Monday through Friday through October 29, 2008.
